Please read these terms and conditions carefully before booking a tour or using our website and services. By making a booking, you confirm that you have read, understood, and agree to these terms on behalf of yourself and all members of your booking party.
IIn these terms, “we,” “us,” and “our” refer to Nomad Unlimited Adventures, and “you” refers to the person making the booking and all travelers included in it.
1. Acceptance of Terms
By accessing our website or making a booking with us, you accept and agree to be bound by these terms and conditions. If you are booking on behalf of others, you confirm that you have their authority to accept these terms on their behalf.
2. Bookings and Payment
A booking is confirmed only once we have received the required payment and issued a written confirmation. Until then, no contract exists between us.
The amount due at the time of booking, and the date by which any remaining balance must be paid, are shown to you at the time of booking and in your confirmation. If a balance is not paid by its due date, we reserve the right to treat the booking as cancelled and apply the cancellation terms below.
Payments are processed securely through our third-party payment processor. We do not store full payment card numbers on our own servers.
3. Prices
All prices are shown at the time of booking and are per person unless stated otherwise. We reserve the right to correct errors in advertised prices before your booking is confirmed.
Unless clearly stated as included, prices do not cover personal expenses, gratuities, optional activities, government-imposed fees, or national park and attraction entrance fees, which remain the responsibility of the traveler. Where parks or destinations charge additional fees for non-resident visitors, those fees are the traveler’s responsibility unless we state otherwise on the tour page.
4. Cancellations and Refunds by You
If you need to cancel a confirmed booking, you must notify us in writing. Cancellation charges may apply and depend on how far in advance you cancel. The specific cancellation terms that apply to your trip are provided at the time of booking and in your confirmation.
Cancellation charges reflect the costs we incur with our suppliers, many of which are non-refundable. Refunds, where due, are issued to the original payment method.
5. Changes to Your Booking
If you wish to change a confirmed booking, such as travel dates or traveler names, we will try to accommodate the request but cannot guarantee it. Changes may incur fees charged by us or our suppliers, which will be passed on to you.
6. Changes or Cancellations by Us
We plan our itineraries carefully, but occasionally we may need to make changes. We reserve the right to alter or cancel a tour, including for reasons of safety, weather, supplier availability, or insufficient bookings.
For minor changes, we will notify you but no compensation is due. For significant changes or a cancellation by us, we will offer you a comparable alternative or a refund of amounts paid for the affected tour. We are not responsible for incidental costs you arrange independently, such as flights or visas. We strongly recommend travel insurance to protect against these.
7. Traveler Responsibilities
You are responsible for ensuring that you and your party meet all requirements to travel, including:
- Holding valid passports, visas, and any other documents required for your destination, and ensuring they remain valid for the required period.
- Meeting any health, vaccination, or entry requirements for your destination.
- Arriving at the designated meeting points and departure times. We are not liable for any part of a tour missed due to late arrival.
- Behaving responsibly and following the reasonable instructions of guides and suppliers. We may remove a traveler from a tour, without refund, for behavior that endangers or seriously disrupts others.
8. Health, Fitness, and Special Requirements
Many of our tours involve physical activity such as hiking and time at high elevation or in extreme temperatures. You are responsible for ensuring that you are fit to participate. If you have any medical conditions, disabilities, or special requirements, please tell us before booking so we can advise whether the tour is suitable.
9. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering trip cancellation, medical expenses, and personal belongings. Travel insurance is your responsibility, and we are not liable for losses that adequate insurance would have covered.
10. Third-Party Suppliers
Some elements of your tour, such as accommodation, transportation, and activities, are provided by independent third-party suppliers. We act as an agent in arranging these services and are not responsible for the acts, errors, or omissions of these suppliers, except to the extent required by law. The terms and conditions of those suppliers may also apply to you.
11. Limitation of Liability
To the fullest extent permitted by law, we are not liable for any loss, injury, damage, delay, or expense arising from circumstances beyond our reasonable control, or from the acts or omissions of third-party suppliers or other travelers. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.
12. Force Majeure
We are not liable for any failure or delay in providing a tour caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, fire, flood, national park or attraction closures, government action, strikes, epidemics, or acts of terrorism. In such cases, we will make reasonable efforts to provide alternatives but cannot guarantee refunds where our own costs are non-recoverable.
13. Photography and Marketing
We may take photographs or video during tours for promotional purposes. If you do not wish to appear in such material, please let your guide know, and we will make reasonable efforts to accommodate your request.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy, which explains what we collect and how we use it. By making a booking, you consent to that use.
15. Complaints
If you have a problem during your tour, please raise it with your guide or contact us immediately so we can try to resolve it at the time. If a matter remains unresolved, please contact us promptly after your tour ends so we can address it.
16. Governing Law
These terms are governed by the laws of the State of Utah, and any disputes will be subject to the courts of the State of Utah.
17. Changes to These Terms
We may update these terms from time to time. The version in effect at the time of your booking applies to that booking. Please review these terms before each booking.
